Anti - Spam Policy

We at Subcribed have very strict policies on people abusing our system to spam. No-one likes spam. Our system is designed as a mailing tool for people who genuinely request information from yourself by opting-in to your database.

Below are the 2 main pointers for you.

We will not, under any cicumstances allow our system to be used under the following conditions:

You must never send unsolicited mail to any person/company/address that has not opted-in to your mailing list.
You must never send unsolicited mail to any person/company/address that includes a reference (directly or indirectly) to subscribed.co.uk.

Any subscriber caught spamming will:

Have their account cancelled immediately.
Be charged for the interruption to service.
Be reported to their own service provider.

Service Agreement.

1. All services provided by subscribed.co.uk may be used for lawful purposes only. Transmission or storage of any information, data or material in violation of UK law is prohibited. This includes, but is not limited to: copyrighted material, material legally judged to be threatening or obscene, material protected by trade secret and/or other statue. The subscriber agrees to indemnify and hold harmless subscribed.co.uk from any claims resulting from the use of the service which damages the subscriber or any other parties. 2. Spamming, or the sending of unsolicited email, using an email address, URL that is maintained on subscribed.co.uk Servers, or directing traffic to a webpage that contains any reference to subscribed.co.uk servers is STRICTLY prohibited. This action WILL RESULT in immediate termination of your account without refund. Any service interuptions as a result of subscribers spamming will be billed to the subscriber at Ł240.00 per hour until service is restored. Subscriber will also be in violation of the subscribed.co.uk Service Agreement and subject to legal action. 3. All payments must be in UK sterling. The subscriber is responsible for providing up-to-date payment information. subscribed.co.uk will not be held responsible should the subscriber's payment be declined for any reason. 4. The subscriber authorises subscribed.co.uk to charge the credit card details given on worlpay.com secure payment page for subscribed.co.uk. 5. The subscriber agrees subscribed.co.uk has the right to delete all data that is stored in the subscriber’s account if the subscriber’s account with subscribed.co.uk is terminated, for any reason. 6. System accounts cannot be transferred or used by anyone other than the subscriber. Accounts which have been transferred to other parties, or show other activity in violation of this paragraph, are subject to immediate cancellation. 7. subscribed.co.uk shall have the right to suspend service to the subscriber at any time, and for any reason, without notice. 8. Subscriber understands that a valid email address is required by subscribed.co.uk for this service. subscribed.co.uk will NOT give your email address to any 3rd party. Any correspondence sent to you comes directly from subscribed.co.uk. 9. subscribed.co.uk exercises no control whatsoever over the content of the information passing through our network. Customers are prohibited from transmitting on or through any of subscribed.co.uk's services, any material that is, at subscribed.co.uk's sole discretion, unlawful, obscene, threatening, abusive, libelous, hateful, or that encourages conduct which would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, national or international law. 10. subscribed.co.uk makes no warranties of any kind, whether expressed or implied, for the service it is providing. subscribed.co.uk also disclaims any warranty of merchantability or fitness for a particular purpose. subscribed.co.uk will not be held liable for any damage suffered. This includes, but is not limited to: loss of data resulting from delays, nondeliveries, misdeliveries, or service interruptions caused by subscribed.co.uk's negligence or the subscriber's errors or omissions. Use of any information obtained via subscribed.co.uk is at subscibers own risk. subscribed.co.uk will not be held liable for the accuracy or quality of information obtained through its services. 11. subscribed.co.uk DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR FREE OR UNINTERRUPTED. THE SERVICE IS DISTRIBUTED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED. subscribed.co.uk WILL NOT BE RESPONSIBLE FOR ANY LOSSES, DAMAGES OR COSTS THAT YOU AND/OR YOUR BUSINESS MAY SUFFER WHEN USING THE SERVICE. YOU AGREE TO INDEMNIFY AND HOLD HARMLESS subscribed.co.uk FROM ANY CLAIMS RESULTING FROM YOUR USE OF SERVICE. YOU EXPRESSLY AGREE THAT USE OF SERVICE IS AT YOUR SOLE RISK. NEITHER subscribed.co.uk NOR ITS SERVICE PROVIDERS, AGENTS, LICENSORS, EMPLOYEES SHALL HAVE ANY LIABILITY FOR ANY DAMAGES SUFFERED BY YOU OR ANY OTHER PARTY AS A RESULT OF THE USE OR MISUSE OF THE SERVICE. 12. Should any provision of this agreement be held to be illegal, invalid, or unenforceable by a court of law, the legality, validity and enforceability of the remaining provisions of this agreement shall remain unaffected thereby unless otherwise stated. 13. This agreement shall be governed by the laws of the United Kingdom. 14. These Terms and Conditions supersede all previous representations, understandings or agreements and shall prevail notwithstanding any variance with terms and conditions of any order submitted. Use of subscribed.co.uk's service constitutes acceptance of these Terms and Conditions.
